On Monday, December 16, Morvillo Abramowitz partner Catherine Foti will speak at the New York City Bar's program, "Criminal Trials in the 21st Century: Exploring the Legal and Ethical Issues Presented by the Electronic Age." The program will address recurring dilemmas in criminal investigations and legal proceedings due to the rise of social media. Questions to be discussed include: Do jury instructions and other strategies actually prevent jurors from misusing the Internet? What are the ethical or legal boundaries in using the Internet during jury selection or to gather information about parties or witnesses? What are counsel's obligations to disclose issues or concerns? Can attorneys use useful evidence found on the Internet as trial evidence? What pitfalls face judges who use social networking sites?
