DOJ Ethics Proposal: An Unwelcome 90’s Reboot

Nearly thirty years ago, Congress wisely put the kibosh on DOJ’s efforts to exempt its attorneys from the state bar ethical regulation to which all lawyers are subject. That has not stopped the current Administration from taking another crack at it. In their latest New York Law Journal column, Morvillo Abramowitz Grand Iason & Anello partners Bob Anello and Richard Albert examine DOJ’s latest effort against the history and text of 1998’s McDade Amendment, 28 U.S.C. § 530B, concluding that it will likely fall to the courts to reject DOJ’s ill-advised overreach.
