This past term, the Supreme Court narrowed the scope of the mail/wire fraud statutes in United States v. Ciminelli and United States v. Percoco.  Both decisions have already affected high-profile prosecutions in the Eastern District of New York.  In one of those prosecutions, United States v. Nordlicht, et al., Judge Brian M. Cogan set aside convictions based on a “right to control” theory of wire fraud.  In Morvillo Abramowitz partner Jonathan S.
