Justices Call Foul on SEC’s Home Court Advantage

The ground is shifting beneath the SEC. Last week's Supreme Court opinion in Lucia v. SEC invalidates the agency's long-held practice of filing enforcement actions before administrative law judges appointed by the SEC staff litigating before it. In my latest blog post, “Justices Call Foul on SEC’s Home Court Advantage” on The Insider: White Collar Defense and Securities Enforcement hosted by Forbes, I discuss the Court’s recent decision, its potential impact on the SEC and other federal agencies, and how the SEC changed sides during the course of the litigation.
