Monaco Memorandum Updates DOJ Corporate Enforcement Policy

October 7, 2022  |  New York Law Journal

For many years, the Department of Justice has used leniency policies to encourage voluntary disclosure by companies. Through these policies, DOJ has sought to hold companies accountable for misconduct and assist in the prosecution of individuals, including senior executives. In my latest article for the New York Law Journal, “Monaco Memorandum Updates DOJ Corporate Enforcement Policy,” I discuss the September 15, 2022, memorandum issued by Deputy Attorney General Lisa Monaco and consider its statements of policy in light of the 2015 Yates Memorandum and other DOJ policy statements. While the DOJ’s policies have been modified over the years, one thing remains certain: companies and their executives face sustained scrutiny for possible criminal wrongdoing.
